Terms of Service

1.1 Platform Purpose and Neutrality

dvtd Technologies Inc. provides a neutral, technology-based polling and public opinion platform. dvtd does not endorse, oppose, or promote any political party, candidate, ideology, organization, cause, or outcome. All polls and results published on the Platform are informational only and do not represent the views of dvtd.

dvtd does not alter, influence, weight, or modify poll outcomes. Vote records are technically immutable: no update or delete operations are permitted on vote records by any user, including dvtd administrators. This is a technical constraint, not merely a policy.

1.2 Eligibility and Accounts

• You must be at least 18 years of age to create an account, create polls, purchase credits, or participate as a Verified Voter.
• You must provide accurate and complete information when creating your account.
• You are responsible for all activity conducted through your account, including activity by anyone you allow to access your account.
• You may not create more than one account per individual or organization. Duplicate account creation to circumvent verification requirements is a material breach of these Terms.
• dvtd reserves the right to suspend or terminate accounts that violate these Terms, at dvtd's sole discretion, with or without notice.

1.3 User Roles

The Platform offers three user roles, each with distinct capabilities:

Company / Brand

May purchase credits, create polls with geographic and demographic filters, view real-time results, and purchase raw anonymized data exports. May not cast votes.

Content Creator

Same capabilities as Company. May additionally embed live poll results via iframe widgets on external websites. After completing Voter Verification, may also vote in polls for which they are eligible.

Verified Voter

Must complete one-time identity verification before voting. May participate in eligible polls anonymously, earn one credit per vote cast, and use earned credits to create polls attributed to their anonymous voter ID. Voter poll creation does not expose the voter's personal identity.

1.4 Identity Verification

To participate as a Verified Voter, you must complete a one-time government-issued ID upload and selfie liveness check conducted by a trusted third-party verification provider (Persona or Stripe Identity). dvtd does not store your ID document images or biometric data. dvtd receives only a verification confirmation token.

Attempting to verify using fraudulent, borrowed, or altered identification is a material breach of these Terms and may result in permanent account termination and referral to relevant authorities.

1.5 Voter Anonymity

Upon successful verification, a UUID-based anonymous voter ID is generated for your account. This identifier, and not your personal identity, is associated with all votes you cast. dvtd's database architecture structurally prevents any linkage between your identity and your voting record. No administrator, court order directed at dvtd, or data export will reveal which individual cast which specific vote, because that linkage does not exist in the data model.

1.6 Poll Creation

Poll creators are solely responsible for the content of polls they create, including the question, answer options, and any associated materials. By creating a poll you represent and warrant that:

• The poll complies with these Terms and dvtd's Acceptable Use Policy
• You have all rights necessary to publish the poll content
• The poll does not violate any applicable law

Poll creation deducts credits from your balance as specified at the time of creation. dvtd reserves the right to remove polls that violate these Terms or the Acceptable Use Policy without refund of credits.

1.7 Immutable Vote Records

Vote records on the Platform are technically immutable. Once cast, a vote cannot be edited, deleted, or retracted — by the voter, the poll creator, or dvtd. This is a fundamental architectural property of the Platform. By casting a vote, you acknowledge and accept this constraint.

1.8 Credits

Platform credits are prepaid digital licenses used to access Platform features. Credits have no cash value, are non-refundable, non-transferable between accounts, and are not financial instruments, securities, or investments. Full credit terms are set out in the Platform Credits — Terms.

1.9 Intellectual Property

dvtd owns all intellectual property rights in and to the Platform, including its software, design, architecture, trademarks, and brand assets. Your use of the Platform does not grant you any ownership rights in the Platform or its underlying technology.

Poll creators retain ownership of the content of their polls (questions, answer options, descriptive text). By publishing a poll on the Platform, you grant dvtd a non-exclusive, worldwide, royalty-free licence to display and present your poll content on the Platform and in aggregated, anonymized reporting.

Aggregated, anonymized poll result data (e.g. percentages, vote counts, demographic distributions) is owned by dvtd and may be used by dvtd for product improvement, research, and marketing purposes.

1.10 Prohibited Conduct

You may not use the Platform to:

• Create polls that violate dvtd's Acceptable Use Policy
• Circumvent identity verification through any technical or fraudulent means
• Attempt to link voter identities to vote records through any technical means
• Scrape, extract, or harvest Platform data in bulk without authorization
• Reverse engineer, decompile, or attempt to access the Platform's source code
• Interfere with or disrupt the Platform's infrastructure
• Use automated bots or scripts to create accounts, vote, or interact with the Platform
• Misrepresent poll results or present them in a materially misleading context

1.11 Data Exports

Raw data exports purchased with credits contain anonymized vote records only. Exports do not contain, and dvtd does not warrant that exports will ever contain, any personally identifiable information. Users are solely responsible for their use of exported data and must comply with all applicable laws governing data use, analysis, and publication.

1.12 Limitation of Liability

To the maximum extent permitted by applicable law, dvtd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, reputation, or business opportunity, arising from your use of or inability to use the Platform, even if dvtd has been advised of the possibility of such damages.

dvtd's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount of credits purchased by you in the twelve months preceding the claim.

1.13 Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. dvtd does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

1.14 Account Termination

dvtd may suspend or terminate your account at any time, with or without notice, if dvtd determines in its sole discretion that you have violated these Terms, the Acceptable Use Policy, or any applicable law. Upon termination, your access to the Platform ceases immediately. Credits remaining in a terminated account are forfeited unless termination results from dvtd's material breach.

You may close your account at any time by contacting hello@dvtd.app. Closing your account does not delete your anonymized vote records, which are immutable by design.

1.15 Modifications to Terms

dvtd may update these Terms at any time. When we make material changes, we will provide notice via email to your registered address and/or a prominent notice on the Platform at least fourteen (14) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

1.16 Dispute Resolution

You agree to first attempt to resolve any dispute with dvtd informally by contacting hello@dvtd.app. If a dispute is not resolved within thirty (30) days, both parties agree to submit to binding arbitration in Calgary, Alberta under the Arbitration Act (Alberta), except that either party may seek injunctive relief in a court of competent jurisdiction.

1.17 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada and applicable Canadian federal law, without regard to conflict of law principles. Where you are located in a jurisdiction with mandatory consumer protection laws, those protections apply to the extent required by law.
